A division bench of Justices Kalyan Shrestha and Sushila Karki scrapped the writ petition stating that the petitioners named members of promotion committee of Nepal Police as defendants instead of making the committee as the defendant. [break]
Justices Shrestha and Karki also stated that the promoted officials secured higher scores than those of the contenders who were not promoted.
However, the apex court issued a directive order against the government to make clear basis and reasons related to scores that are given to officials for promotions.
SSPs Ravi Pratap Rana, Purna Singh Khadka, Manohar Prasad Rimal, Ram Kumar Khanal, Tara Prasad Lamichhane and Gyanod Raj Upadhyaya on December 22, 2012 had moved the apex court claiming that the government promoted police officials junior to them.
A cabinet meeting held on December 18 last year had promoted SSPs Shyam Bahadur Khadka, Navraj Silwal, Praksh Aryal, Jaya Bahadur Chand and Bam Bahadur Bhandari to the post of DIGs.
The petitioners had claimed that except Khadka other officers are junior to them. Stating that the government´s decision was against the Interim Constitution and the police regulations, the petitioners have urged the SC to scrap the decision. The Prime Minister´s Office, the Ministry of Home Affairs and the Police Headquarters, among others, were made defendants in the writ.
