Lack of budget among hurdles to strategic plan: SC

KATHMANDU, Aug 26: A mid-term report of the Supreme Court (SC) has pointed out several problems and challenges in the effective implemention of the Second Five-Year Strategic Plan for the Judiciary, 2009/10-2013/14.



The report states that the mechanism at all the courts for implementing the plan has remained ineffective due to lack of means and clear work description. [break]



"Though the strategic plan projects the necessary budget for implementing programs incorporated in the plan, it has not made sufficient budgetary resources available. That is why budgetary means persist as the major problem in implementing the plan effectively," reads the 247-page report prepared by the apex court recently.



The report also terms the allocation of the budget for the judiciary by the government rather than by the judiciary itself as adverse to judicial independence. "This is an added challenge to implementing the strategic plan," it adds.



The report has pointed out a lack of expertise, capability and skills for modernizing the case management system as another challenge to the strategic plan, which was brought into implementation two and half years ago.



"To completely control the delay in the settlement of cases remains a major problem and challenge in implementing the strategic plan," the report points out.



Similarly, the report has termed the lack of promulgation of new laws and lack of reform in existing laws and terms of reference (ToR) as challenges to implementing the judiciary plan.



"Increasing people´s faith in the judiciary through delivery of judicial services also remains a challenge for the implementation of the plan," says the report.



The report has recommended developing the work skills and capabilities of judicial manpower.



Likewise, the report has suggested preparing a clear timeline regarding transfer of justices, saying that transfers also affect the implementation of the plan. The report has stressed the need for setting up a human resource division.
