SC verdict on Gupta positive: Lawyers

KATHMANDU, Feb 22: Former President of Nepal Bar Association (NBA) Bishwakant Mainali on Wednesday said that the Supreme Court (SC)´s verdict against Madhesi People´s Rights Forum-Republican (MPRF-R) Chairman Jaya Prakash Prasad Gupta should not be politicized.



The Supreme Court on Tuesday convicted Gupta in a corruption case on finding that he had amassed movable and immovable property worth Rs 8.4 million from unknown sources after holding public office in different capacities from 1992 onwards. [break]



“It was a criminal case and must be seen as such. It must not be given political color by terming the verdict as anti-racist or anti-region,” stated Mainali at a program organized by Reporters´ Club Nepal on Wednesday.



He said that politicizing the verdict would be counterproductive.



Mainali stated that the Judicial Council should now decide on the fate of the judges of the Special Court, Bhoop Dhoj Adhikari, Cholendra SJB Rana and Komal Prasad Sharma, who had earlier given clean chit to Gupta.



Speaking at the same function, constitutional expert Dr Bhimarjun Acharya termed the apex court verdict as courageous. “This is a good beginning. Now, other corrupt people must also be brought within the ambit of law,” said Acharya.



He also stressed on the need of eradicating irregularities in the judiciary.



Senior Advocate Ramnarayan Bidari took strong exception to the delay in delivery of verdicts on corruption cases.



“Delay in the delivery of verdict itself is a kind of corruption,” said Bidari. However, he lauded the SC verdict that sent a corrupt incumbent minister to jail as positive.
