Petition against directive on poll observation

KATHMANDU, Oct 1: A writ petition was filed Tuesday at the Supreme Court (SC) against some provisions of the directives on election observation for the upcoming Constituent Assembly (CA) election scheduled for November 19.



Advocates Shri Krishna Subedi and Rabin Subedi and Chairman of Election Observation Committee-Nepal Pradip Pokhrel moved the apex court challenging the provision in directive on election observation that the observers cannot be deployed to a polling booths that are situated at the permanent address of the observers.[break]



The writ petitioners have argued that such a provision will deprive the election observers from voting rights.

Similarly, they have challenged the election observation provision related to academic qualifications of observers. They have claimed that the criteria will disqualify most of the observers.



According to the newly-introduced provision in the directive, an election observer should have a bachelor´s degree while an experienced observer should have passed the intermediate level. Such academic qualifications were not mandatory for the last CA election.



The writ petitioners have claimed that the provisions in the directive are against the spirit of the interim constitution.

They have urged the apex court to issue an interim order against the defendants and not to implement the provisions terming them (provisions) ´unconstitutional´ and ´illegal´.

The constitutional body has already granted its permission to 51 observation groups.



Office of the chairman of the Interim Election Council and the EC are named as defendants in the writ petition.
