Govt to ask SC to review TRC verdict

KATHMANDU, April 22: Government has finally decided to go to the Supreme Court (SC) seeking a review of the apex court's previous verdict on annulling some provisions in the transitional justice mechanism, said a minister.

Minister for Law and Justice, Narahari Acharya, who also looks after the Ministry of Peace and Reconstruction, said that the government is preparing to file a review petition at the apex court seeking revision of its earlier decision on February 26.


"We are mulling the possibility of a revision to the SC's verdict after the Maoist parties made a request to the government," said Acharya.

Prime Minister Sushil Koirala assured of seeking a review of the SC verdict in a meeting with the UCPN (Maoist) senior leaders at his official residence in Baluatar on Monday, said UCPN (Maoist) Vice-Chairman Narayan Kaji Shrestha.

"The prime minister agreed with us for seeking review against the SC's earlier verdict during the meeting," said Shrestha. UCPN (Maoist) and other Maoist parties have been pressing the government to seek review against the SC's decision, stating that it was against the spirit of the peace process.

The SC had annulled two controversial provisions of the Truth and Reconciliation Commission (TRC) and Commission on Inquiry into Enforced Disappearances (CIED) Act that gave discretionary powers to the transitional justice mechanisms for amnesty and to the Ministry of Peace and Reconstruction to prosecute human rights violators. The apex court had also stated that cases that are sub-judice at various courts cannot be transferred to any commissions made to oversee transitional justice mechanism.
