According to information disseminated by Advocacy Forum on the April 12 decision of the UNHCR, the government is required to investigate into the torture meted out to Giri in the given time frame and to report back to UNHCR. [break]
Giri, a resident of Banke, was arrested by the army in April 2004 under then terrorist law and was detained illegally at Immanagar Army Barracks in Banke district. The barracks was under the supervision of then mid-Western Divisional Headquarters of the Nepal Army. Ex-army chief Rookmangud Katuwal was the chief of the Divisional Headquarters then. The victim has also sought investigation into Katuwal under the doctrine of command responsibility.
Giri has submitted his application for justice before the UN rights committee after he could not get justice from the authorities in Nepal, exercising his rights guaranteed by the International Covenant for Civil and Political Rights (ICCPR) to which Nepal is a party.
“It is the moral responsibility of the government to abide by the decision of the UN-HCR,” said Mandira Sharma, director of Advocacy Forum, at a press conference organized to disseminate the decision.
When asked what would happen if the government ignores the decision, human rights activist Subodh Pyakurel said, “The international community will question the government on moral grounds.”
