Advocate Dayaram Humagain and Bishnu Bhakta Khatri moved the court arguing that the government decision to appoint Yadav is in contravention of the Interim Constitution. [break]
The petitioners have urged the apex court to annul the government´s decision. They have also demanded scrapping of the provision of the Press Council Act 1992 regarding appointment of the PCN chairman arguing that the provision is in contravention of Article 106 (1) of the Interim Constitution.
They, in the petition, have stressed the need for amending the Press Council Act 1992 in accordance with the Interim Constitution.
The government had appointed Yadav as PCN chairman on Friday for a four-year-term.
Article 106 (1) of the Interim Constitution states that no chief justice or judge of the Supreme Court shall be engaged in or deputed to any assignment other than that of a judge.
The appointment of Yadav is being criticized by legal experts and journalists because of a verdict issued by him on insurgency related cases. Yadav had ordered that regular judicial system cannot decide on cases related to the insurgency.
