The supporters of Jakir Hussein Miyan, a Member of Legislative Assembly of the Indian state of Bihar, took to streets from early morning in Jogbani, throwing the Nepal customs offices out of gear all throughout the day. They say that Miyan has been framed by the Nepal police under false charges. [break]
Miyan, along with his accomplice Bhola Shankar Tiwari, was arrested by a special squad deployed from the District Police Office of Morang in Kakadvitta of Jhapa. Miyan and Tiwari both were wanted by the police for their alleged involvement in abducting a Nepali businessman 11 years ago.
Tulasi Agrawal, who belongs to Bishal Group, was kidnapped in Biratnagar on January 26, 2002. Tulasi, who was held captive for 41 days, was freed only after his family reportedly paid a ransom of over Rs 20 million. Later, Jagdish Chandra Agrawal, Tulasi´s younger brother, had lodged an official complaint against 10 people, including Miyan and Tiwari, at the District Police Office of Morang.
The agitating cadres of Lok Jansakti Party, a Bihar-based political party of which Miyan is belongs to, have claimed that their leader was innocent because he was already in a Bihar jail when Tulasi was kidnapped and extorted. At that time, Miyan was arrested by the Bihar police for his alleged role in the murder of Pappu Yadav, one of Bihar´s notorious gangsters.
One of the 10 accused, Pappu Dev Bhumihar, has already been sentenced to 10 years in jail. Bhumihar, against whom the Morang district court handed down jail sentence in 2006, is now placed in a prison in Palpa district.
Umesh Giri, another accused, was acquitted by the district and the appellate court. Giri´s case is now sub-judice at the Supreme Court (SC). Four of the accused, including Giri, are Nepali nationals.
On December 21, 2006, the Morang district court had directed the police to ´produce the absconding accused (including Miyan and Tiwari), if arrested ever´. "We will produce them at the district court on Sunday,”said DSP Uma Prasad Chaturbedi, spokesperson for Morang police. "We always had a close eye on them. We arrested them when they entered Nepal.”
