The crusher plant owner demanded the extraction of river aggregates through a writ petition at a time when stakeholders from all quarters in Parbat district have strongly criticized the unabated illegal extractions.
The petitioner had made the District Development Committee (DDC), District Administration Office (DAO) and District Police Office (DAO) as defendants.
Earlier, while the extraction was going on in full swing at midnight on April 10, the police had impounded an excavator and three tipper trucks belonging to the Kali Gandaki Crusher Factory. Handing over the seized vehicles and earth-moving equipment to the DDC, the police had recommended strong action against the crusher factory. Following the incident, the crusher plant operator filed a writ petition at the appellate court.
The petitioner claimed highhandedness of the police despite its agreement with the DDC to excavate stones, gravels, and sand from the river.
In the preliminary hearing, the bench of Appellate Court Judge Lohit Kumar Shah has ordered the defendants to be present before the court on Monday.
The Kali Gandaki Crusher Factory is reportedly involved in the illegal and rampant excavation activities, that have continued during nights since last month. Such unabated and illegal extraction of aggregates from the Kali Gandaki River has created a 10-meter deep hole in the riverbed and has also endangered the nearby Raja Bagar settlement.
It is learnt that the crusher plant has started excavating aggregates from the Kali Gandaki River since DPO Chief Ganga Panta went abroad.
On the day of his arrival in the district, the equipment and vehicles belonging to the crusher plant were impounded from the excavation site at night. He had earlier warned of action against crusher plants involved in illegal extraction from the river.
