Administrative reform a challenge post constitution

KATHMANDU, Sept 24: Nepal has formally embraced federalism in the new constitution. The country will have now three main levels of government structures: federal, provincial and local.

But transforming the existing unitary administrative structures to match a federal setup will remain a major challenge in the post constitution promulgation scenario as the government has to set up many new administrative structures and overhaul the existing laws to match the requirements of a federal structure, say experts.


A High-Level Administrative Reform Suggestion Implementation Committee formed by the government to suggest reform in its administrative structures states that over 300 existing laws will have to be amended to bring them in line with the new constitution.

"Laws have to be revised, many administrative structures will have to be established and manpower be managed subsequently. It is going to be a lengthy and difficult process," said Kashi Raj Dahal, chairman of the committee.

The constitution has also made a provision that 20 different issues will be dealt with by the federal government, 28 other different issues by provincial government and 20 issues by local government. And it has also stated that the government should make all the necessary preparations to amend exiting laws and transform administrative structures into the federal set-up within three years of the promulgation of the constitution.

"Transforming the existing administrative structures in line with the federal structure by changing existing laws will be an important task. But most importantly, the change in the administrative structures should be able to give a huge sense of relief to local people in terms of service delivery," said Dahal, adding, the government should set up all the service delivery units of the government in a single area in the local level.

Last week, the committee has already asked all the ministries to set up a technical team to review the existing law and propose for amendments.

So, for the next three years, as part of transitional plan, the federal government will deploy government employees from the central-level in the provincial and local levels and work on institutional development of administrative bodies such as the Public Service Commission, according to Ministry for General Administration (MoGA).

"Until then, existing government structures will continue to provide service to the public," said Bishnu Hari Uphadaya, deputy spokesperson of MoGA.

Chairman Dahal said that transformation of administrative structures in line with the federal set up depends on how fast issues like fixing capital of provinces get settled.
