Four years after the Commission for the Investigation of Abuse of Authority (CIAA)´s filed the graft case, a division bench of then SC Chief Justice Ram Prasad Shrestha and Justice Sushila Karki on 27 March, 2011 had directed Khadka to appear before the court.

The hearing on the case had begun from 24 October, 2011 following the order issued by a division bench of Kalyan Shrestha and Tarka Raj Bhatta on 7 August, 20011.

The CIAA´s on 29 March, 2007 had appealed against the judgment by the Special Court.

A bench of the tribunal´s then Chairman Bhupadhwaj Adhikari and members Komal Nath Sharma and Cholendra Samasher JBR on 15 November, 2006 had given clean chit to Khadka.

CIAA has accused Khadka of acquiring Rs 23.6 million from undisclosed sources while he held several ministerial portfolios.
