The court took the decision after a group of lawyers led by advocate Madhav Basnet moved the apex court with a petition questioning the constitutionality of the government plan.
Taking up the public interest litigation by the lawyers, Justice Mohan Prakash Sitaula on Friday ordered the government to send its representative (lawyers) to take part in the discussion.
The government is planning to establish the benches in this fiscal despite protests by the legal community. Currently a committee headed by Justice Khil Raj Regmi is studying how the benches can be set up.
