KATHMANDU, Nov 24: The legal experts have termed the President´s Friday move as ´unconstitutional´ and ´non-political´ on Saturday.
During a meet called by Prime Minister Baburam Bhattarai at the PM´s official residence in Baluwatar, the legal experts have expressed that President Ram Baran Yadav had no constitutional right to call for the parties to find consensus PM within a week.[break]
According to senior lawyer Raghav Lal Baidya, President Yadav has entangled himself further calling for consensus PM. He advised the Prime Minister to carry on with the daily works of the government abiding by the constitution and law.
The President has no right to call for parties to nominate a prime ministerial candidate through consensus and come up with an appropriate proposal to form a new government within the next seven days at a time when the country does not have a legislature-parliament, said Ramnath Mainali, senior lawyer. "This is neither a constitutional nor political step of the President," he said.
Likewise, another senior lawyer Raman Shrestha also had similar views on President Yadav´s move. "President Yadav has further escalated the political uncertainty in the country. This step should be condemned by everybody, " he said.
Other legal experts present at the meet, Borna Bahadur Karki, Krishna Pokharel, Shyamji Pradhan, Deepak Bista and Bal Krishna Devkota also criticized the President´s move and termed it ´unconstitutional´. They were also of opinion that should the president appoint a new Prime Minister, it would be an end of the interim constitution.
