Avishek´s elder brother Kamal has been sentenced to five years in jail, and Deepak Thapa Magar and Hem Thapa Magar for three years each in the same case. Naresh Sharma, Anil Giri and Bikram Thapaliya have also been acquitted. All those exonerated of the murder charge were released by Jhumka Jail later in the day.
Avishek was arrested in possession of a sword after Yadav´s murder following a dispute about Morang District Development Committee tender three years ago. “I was wronged and the court has given me justice,” Avishek said after the verdict.
Avishek was brutally attacked by a gang of Morang Chief of Youth Association of Nepal Parshuram Basnet on June 1, 2011 on the court premises where he had been taken for a hearing on the case.
Avishek and Basnet were partners in many businesses including construction contracts. They later parted ways and their groups competed in securing government contracts. Avishek was acquitted of abduction, extortion and call-bypass charges while in jail.
Meanwhile, Morang Police has decided to adopt a special strategy to curb possible criminal activities by Avishek´s gang.
“We will take special initiatives to avert other criminal activities,” Deputy Superintendent of Police (DSP) Uma Prasad Chaturvedi said.
