Writ petition against case withdrawals

KATHMANDU, March 11: A group of lawyers on Sunday moved the Supreme Court (SC) questioning constitutionality of the government´s decision to withdraw criminal cases against 425 individuals.



The lawyers led by advocate Madhav Kumar Basnet have argued that withdrawal of criminals cases would encourage criminals and asked the apex court to cancel the February 27 decision of the cabinet. [break]



The present coalition had withdrawn cases related to murder, attempted murder, arson, possession of arms, and armed robbery.

 

While seeking the apex court´s order to nullify the cabinet decision, the writ petitioners have argued that the cabinet decision not only violated the existing constitutional provisions but also breached Nepal´s commitment to international human rights instruments.



They have further argued that the implementation of the decision would have serious ramifications on criminal justice system of the country.



The Office of the Attorney General has already directed its offices in districts to begin the process of withdrawing criminal cases as decided by the cabinet.



The writ petitioners have also demanded that the court immediately stay implementation of the decision.
