Withdrawal of criminal case challenged in court

KATHMANDU, Dec 31: A writ petition was filed at the Supreme Court (SC) on Monday against the government´s December 6 decision to withdraw a criminal case.



Khushi Lal Sah of Majhaura VDC, Siraha moved the apex court urging the SC to stay the government´s decision to withdraw the case against Bholai Sahu Teli, who was charged with killing his own father. [break]



The petitioner has also urged the apex court to scrap all action the government has taken following its case withdrawal decision.



The petitioner has argued that the government cannot withdraw a criminal case under the pretext of its being a political case. He has stated that the incident had taken place at a time when there was no insurgency in the country.



Sah has also argued that the government decision was against the SC´s verdict issued on May 3 which states that government cannot withdraw a case of an accused who is absconding, and other sensitive cases. The petitioner has maintained that the government cannot withdraw a sub-judice case.



According to the petition, the government on December 6 had decided to withdraw the case against Teli as per October 30 recommendation of the Ministry of Home Affairs.



Teli was beaten to death by local leaders and cadres on August 2, 2010 following minor disputes.
