Sthapit moves court against sack

KATHMANDU, Jan 21: Three days after the cabinet´s decision to sack him from the post of commissioner of the Kathmandu Valley Town Development Authority (KVTDA), Keshav Sthapit on Monday challenged the government´s move at the Supreme Court.



A cabinet meeting on Thursday had sacked Sthapit from the post and appointed Yogeshwar Krishna Parajuli to the post. [break]



Sthapit moved the apex court demanding annulment of the government decision and his reinstatement.



Sthapit, in his petition, has maintained that he has done a lot in his capacity as KVTDA commissioner for the development of Kathmandu Valley including road expansion for the past nine months despite non-cooperation from the government bodies.



Sthapit, who is also former mayor of Kathmandu Metropolitan City, has claimed that the move to sack him from the post ´forcefully´ is unconstitutional and illegal because citing the act which says his term is for five years.



A cabinet meeting held on April 27, 2012 had decided to appoint Sthapit as the head of the KVTDA. He was given an appointment letter by the government two days after the cabinet decision.



Sthapit had tabled various agenda on development of the capital city on May 9, 2012. After his performance came under question, he was asked to submit a progress report on January 1, 2013. Sthapit on January 6 had submitted a 17-page report before probe committees formed by the government.



Sthapit has stated that the three different probe committees did not give him any chance to furnish clarification. He was sacked as Prime Minister Baburam Bhattarai was reportedly unhappy with Sthapit´s working style.



The prime minister, his office, newly appointed Commissioner of KVTDA Parajuli, Ministry of Physical Planning and Works, Ministry of Finance and KVTDA, among others have been made defendants in the petition.
