The single bench of SC Justice Tahir Ali Ansari issued the order to this effect in response to a habeas corpus writ filed by Batala´s widow on Thursday. [break]
Police had filed a case against Batala at Kathmandu District Court on Wednesday, charging him with abducting Koteshwor businessman Shrestha in April, 2008.
Shrestha was killed while in Maoist captivity.
Ex-Maoist combatant Batala spent three years in Chitwan jail during his trial as an accomplice in the murder and was eventually released by Chitwan District Court as he had already served time equal to his jail term. Police re-arrested him on May 25 and charged him with abduction.
Police are yet to nab Kali Bahadur Kham, a UCPN (Maoist) central committee member and the main accused in the murder case.
Meanwhile, the SC on Friday summoned both plaintiffs and defendants for detailed hearing on a writ petition filed against UCPN (Maoist) lawmaker Bal Krishna Dhungel, who was convicted by Okhaldhunga District Court of murdering Ujjan Kumar Shrestha during the conflict period. Dhungel has been absconding following the court verdict.
The apex court has also sought written clarifications from CA Chairman Subas Nembang and Home Minister Krishna Bahadur Mahara for not implementing a court verdict. Nembang has been asked to furnish clarifications why he did not suspend Dhungel following the court verdict, while Minister Mahara has been asked why he is trying to secure a pardon for Dhungel.
A writ petition was filed at the apex court demanding a court order to send Dhungel to jail as per the court verdict.
