Jammakatel had filed a petition at the apex court on Sunday demanding a stay order against the government´s decision to withdraw the charges. The government was preparing to withdraw charges against the alleged attackers on July 17 by portraying it as politically motivated.
“I will be denied justice if the government decision to withdraw the case is implemented as the case is still sub judice,” Jammakatel has said in his petition.
Jammakatel was attacked in the Babarmahal area of the capital last year. He was rushed to the nearby Norvic Hospital.
He then filed a case at Kathmandu District Court (KDC) on November 20, 2011, demanding stern action against Taranidhi Pant, Ram Pudasaini, Kamal Bahadur Budhathoki, Indra Bahadur Shahi Thakuri and Sudip Karki alleging them of involvement in the attack. However, the court granted bail to Pant while sending the rest to the judicial custody.
Jammkatel moved Patan Appellate Court demanding that Pant be remanded to judicial custody along with others. The appellate court has sought necessary documents on the case from KDC.
