SC refuses petition on statute interpretation

KATHMANDU, Feb 10: The Supreme Court (SC) on Sunday has refused to register a writ petition that demanded interpretation of the entire interim constitution and a writ of mandamus to enforce the interpretation as per article 116 of the interim constitution to resolve the current political deadlock.



SC registrar Lohit Chandra Shah issued an order in this regard saying the issue had already been raised by advocates Rajesh Silwal, Jayaram Shrestha and Achyut Prasad Kharel and is sub-judice at the court. The apex court has said that it cannot register petitions on the issue time and again. The petition was placed by advocate Chandrakanta Gyawali.[break]



Gyawali had moved the apex court demanding interpretation of the interim constitution as the Constituent Assembly (CA) was dissolved without promulgating a new statute, and the government failed to hold fresh polls on the stipulate deadline of November 26. The petitioner had also argued that it was not possible to hold CA election by mid May as announced by the government.



The petitioner has also stressed the need for interpretation of the interim constitution stating that political parties have failed to form a national consensus government even after repeated deadlines issued by the president.
