A writ petition was filed at the Supreme Court against Jha, questioning constitutional grounds to assume the office after the apex court´s verdict. A special bench of five SC justices has started hearing Jha´a case. The bench is likely to issue its verdict on Wednesday on whether to dismiss Jha´s vice-presidency until he takes a fresh oath in Nepali language.
Tuesday´s hearing was deferred till Wednesday after one of Jha´s lawyer pleaded before the court that the petitioners had not sought stay order in their writ. However, the special bench comprising justices Tapa Bahadur Magar, Kalyan Shrestha, Ram Kumar Prasad Shah, Bharat Raj Uprety and Prem Sharma said that the petitioners had demanded stay order in the writ. The bench made a ruling to continue the hearing over the case on Wednesday as well.
Petitioners -- Nava Raj Neupane and Bishnu Prasad Bastola of Kathmandu Metropolitan City-15 -- had filed the writ petition against VP Jha some two weeks ago. The duo sought stay order from the apex court to compel Jha to take oath in Nepali.
“VP Jha must quit his post if he does not take fresh oath of office and secrecy following the court verdict,” maintained the writ, adding: “He has no constitutional ground to continue the office since he has already defied court´s verdict.” VP Jha has already ruled out taking oath in Nepali language.
