Ordinance controversy at president's door

KATHMANDU, Feb 8: The controversy over the government decision to formulate three new laws through ordinance has now reached Shital Niwas from Singha Durbar. [break]



On Sunday, Office of the Prime Minister and Council of Ministers forwarded ordinances related to disappearances, voters’ list and inclusion in public service to the Shital Niwas for presidential seal, according to a senior government official. The ordinances will become law only after President Dr Ram Baran Yadav approves them.


“Yes, we received the ordinances today (Sunday),” said Rajendra Dahal, president’s press advisor.



A cabinet meeting last Thursday had decided to introduce three ordinances despite opposition from Nepali Congress and the legal and human rights community. They maintain that the ordinances undermine the parliamentary and democratic system.



Even ruling Communist Party of Nepal (Unified Marxist-Leninist) has continued to voice its protest over government decision to introducing the laws through ordinances. Talking to representatives of international media mission, which ended its five-day visit to Nepal on Sunday, CPN-UML General Secretary Jhala Nath Khanal voiced his party’s reservation over introducing laws through ordinance and without oversight of the parliament. Khanal said his party agreed only on introducing the ordinance related to voters’ list, and not on two others.



Nepali Congress has already announced it will hold consultations with other political parties on the ordinances.



“The president has yet to study the content of the ordinances,” Dahal said talking to myrepublica.com.



Asked when the president will promulgate the ordinances, Dahal said he would consult with constitution experts for the continuality, legality and procedure of the ordinances before approving them.



The president has already begun consultations on ways to deal with the controversy. Last week, the president met lawyers, speaker and politicians from different parties to learn about their views on the dispute.
