Maoist parties for bringing war-era sub judice cases under TRC jurisdiction

KATHMANDU, April 20: Five Maoist parties have decided to press the government to amend the Truth and Reconciliation Commission (TRC) Act with a provision of bringing the war-era sub judice cases under the jurisdiction of the commission from various courts.

A meeting of UCPN (Maoist) and four other splinter groups from the same party, held at UCPN (Maoist) party office at Perisdanda on Wednesday, decided to pile pressure on the government on the issue.

The former Maoist rebels' demand to transfer the sub judice cases from the courts to TRC has come at a time when the victims and international human rights agencies have been urging the government to make the transitional justice act on par with international standard.

The parties have also objected over the recent order of the apex court regarding the war-era cases.  “Even after Truth and Reconciliation Commission started looking after war-era cases, the Supreme Court recently issued an order against former lawmaker of UCPN (Maoist) Keshav Rai. We have taken this issue seriously,” said the party lawmaker Ram Narayan Bidari.

CPN (RM) Secretary Dev Gurung argued that no other courts should be given the authority to look after the insurgency-era cases after the TRC began receiving complaints over the same issue.

“The courts do not have the rights to look after the war-era cases, but general courts are declining to transfer those cases to the jurisdiction of TRC,” said Gurung.

New political force campaigner Hisila Yami, who was also at the meeting, said that their objection is over the power exercise by the courts on war-era cases.

Heads or leaders from Mohan Baidya-led CPN (Revolutionary Maoist), Matrika Yadav-led CPN (Maoist), Mani Thapa-led Revolutionary Communist Party and Baburam Bhattarai-led Naya Shakti have also decided to establish joint legal desk to help the war-era victims from the state sides for assisting them to file complaints at the TRC and the Commission for Investigation on Enforced Disappeared Persons (CIEDP).

All five Maoist parties have decided to convene interaction over the issue in the second week of May.
