According to Sunil Pokharel, general secretary of NBA, said the meeting arrived at a conclusion that the issuance of Monday´s apex court statement, in which Chief Justice Khil Raj Regmi had indicated his willingness to head the poll government, was ´an unconstitutional´ move. [break]
Pokharel said the meeting had an opinion that the way the chief justice holding talks with party leaders, who are the respondents in a petition filed by Bharat Jangam challenging the proposal of appointing Regmi as the government head, can influence the case which is still sub judice in the apex court.
Issuing a press statement after the meeting, the NBA said the interim constitution does not envisage assigning the chief justice to any tasks other than those related to judicial inquiry and that in case, the judiciary head is deputed to any such task there is no constitutional provision for him to return to his previous duty.
The NBA further said that given the chief justice´s statement in the media that he has already accepted the offer of premiership, the judiciary head should stop hearing cases as doing that would be against the code of conduct for a judge.
