Apex court postpones hearing on CJ -led govt further

KATHMANDU, March 14: The hearing of the writ petitions earlier filed at the Supreme Court against the formation of a chief justice-led election government has been postponed further, on Thursday.



Hemanta Rawal, deputy spokesperson for the apex court, informed about the postponement of the hearing of the petitions originally intended to bar Chief Justice Khil Raj Regmi from assuming executive post. The new date of the hearing has not been fixed yet. [break]



The apex court on March 7 had deferred the hearing till today of a petition filed by advocate Bharat Jangam. The court had then said it would conduct the hearing of the petition jointly with another petition filed by Om Prakash Aryal, maintaining that the two petitions are similar in nature.



Today’s scheduled hearing, the court said, could not be conducted as Justice Ram Kumar Sah, an apex court judge who had been looking into the petitions along side fellow judges Sushila Karki and Girish Chandra Lal, was automatically drafted into the Judicial Council following CJ Regmi assuming the post of executive head today.



The Judicial Council has also been made one of the opponents in Jangam’s petition. The court has cited as a reason for today’s hearing deferral the norm that no judge can hear a case in which the judge himself has been made opponent.
