SC upholds Sanjay Sah's jail term

KATHMANDU, Sept 17: The Supreme Court (SC) on Thursday upheld the one year and nine months jail term handed down to former state minister and lawmaker Sanjay Kumar Sah for possession of illegal arms by Janakpur Appellate Court (JAC).

A full bench of justices Baidyanath Upadhaya, Devendra Gopal Shrestha and Cholendra SJB Rana handed down its verdict on the case, which had been making rounds at the apex court since 2006.In 2004 Sah was handed a jail term of one year and nine months by the Dhanusha District Administration Office, for carrying a 9 mm pistol and terrorizing locals at Sakhuwa area of Mahendranagar on May 17, 2003. The sentence was later upheld by JAC on June 13, 2006.

However, Sah had challenged its decision by appealing for review at the SC the same year. On June 7, 2011, a division bench of Justices Abadhes Kumar Yadav and Kamal Narayan Das suggested that the case should be taken up by a full bench after the duo came up with contradictory views on the case.

Along with this, Sah also faces charges for masterminding the 2012 Janakpur Bomb Blast. He was taken into judicial custody in April 2014 as primary suspect in the blast that killed five. The Dhanusha District Court (DDC) on May 8, 2014 had ordered for taking him into judicial custody. Sah had moved the SC on January 18, 2015 after JAC upheld DDC's order.
