SC scraps petitions against NA recruitment

KATHMANDU, July 29:  The Supreme Court (SC) on Wednesday scrapped all cases over recruitment in the Nepal Army stating that issuing any verdict on the issue was “beyond its jurisdiction”.



A division bench of SC justices Bal Ram KC and Gauri Dhakal concluded that the issue about NA recruitment cannot be dealt by the judiciary as the issue is related to the Comprehensive Peace Accord (CPA). [break]



Two separate petitions were filed at the SC against NA´s decision to recruit 271 technical personnel some four months ago.



On February 17, 2009 and March 5, 2009, two other petitions were filed at the apex court challenging the NA´s decision to recruit around 3,000 personnel. They argued that the Army´s move violated CPA, which restricts both the Maoists and the NA from recruiting additional personnel.



The SC had then issued an interim order staying the NA´s recruitment. The stay order was in effect until Wednesday´s ruling. Later on April 19, advocates Sri Krishna Subedi, Abhaya Raj Joshi, among others, had filed two similar petitions after the NA issued vacancy notice for 271 technical personnel.
