NBA officials handed over a memorandum to CA chair Subas Nembang at his office in Singha Durbar on Sunday urging him to step in to scrap the provision of parliamentary control over judiciary. “The provision to endorse appointment of judges by the legislature, which also has the power to take action against them, is against the principle of separation of power and the fundamental principle of judicial freedom passed by the United Nations,” reads the memorandum.
The NBA has also objected to the provision that would authorize the legislature at the center and provinces to interpret the constitution and the laws. The memorandum states that the NBA has been stunned by the constitutional provisions passed by the CA committee on the judicial system.
“Such provisions don´t only violate the established principles, norms and values, but also affect the democratic image of the country. Such provisions are against the universal principles of justice,” states the memorandum.
