CA mandates CC to settle disputes

KATHMANDU, Jan 18: A Constituent Assembly (CA) meeting on Tuesday endorsed a proposal for amending the CA regulations to entrust the CA´s Constitutional Committee (CC) with the responsibility of settling the differences in the preliminary drafts of the constitution prepared by thematic committees.[break]



Originally the CC was mandated to prepare an integrated draft report by incorporating reports of all thematic committees for new constitution.



Eight thematic reports prepared by CA committees couldn´t be forwarded to the CC due to a provision in the CA regulations that required that the reports could be forwarded only after resolving all differences. Only three thematic drafts were forwarded to the CC after resolving all the differences.



The parties are yet to resolve altogether 83 disputes pertaining to constitution-writing.



Now with the amendment to the regulations, the CC can take on the disputes and try to settle them besides carrying out its responsibility of preparing an integrated draft of the new constitution.



At the same time, attempts to resolve disputes will also be made by the all-party mechanism in the CA and informal meetings of top party leaders. If the CC and other mechanisms fail to settle the differences, the unresolved disputes will finally be tabled at the CA meeting to resolve them through vote.



Though the regulations had originally envisioned that all 11 thematic drafts would be forwarded to the CC together, a previous amendment made it possible to forward the drafts separately.
